从“权力错位”到“权责明晰”:学位评定委员会与学位论文答辩委员会的关系重塑——以学位授予案件为切入口

摘　　要：学位评定委员会与学位论文答辩委员会是学位授予所涉的两大基本组织,二者关系的良性建构关乎新型校院关系的形成和高校内部治理体系的优化。通过审视1998年以来96起学位授予案件,发现学位评定委员会与学位论文答辩委员会之间存在权力失衡、关系错位以及权责划分不合理等矛盾。究其法理根源,两者在法律设计中存在“柔性”与“刚性”的权力不平衡、科层制影响下的“上下级”地位不平等以及学位授予程序“答辩在前—审查在后”等缺陷。以学位法制定为契机,未来可通过厘清二者在学位授予中的权责边界和平等地位、设计科学合理的学位授予程序,以期在法律层面重塑学位评定委员会与学位论文答辩委员会的关系。The Degree Evaluation Committee and the Dissertation Defense Committee are the two basic organizations involved in degree awarding.The former is a compound organization that implements administrative review and academic evaluation at the school level,and the latter is an academic organization that judges the academic level of dissertations at the college level.The benign construction of the relationship between the people is related to the formation of a new school-school relationship and the optimization of the internal governance system of the university.This research examines 96 degree-granting cases since 1998,and finds that there are contradictions between the degree evaluation committee and the dissertation defense committee,such as power imbalance,relationship dislocation,and unreasonable division of powers and responsibilities.Investigating its legal roots,there is an imbalance of power between"weak"and"tough"in the legal design of the two,the unequal status of the"subordinate and superior"under the influence of the bureaucracy,and the degree-granting procedure"defense first-review second"The defect is the deep-seated cause.Taking the enactment of the"Degree Law"as an opportunity,in the future,we can reshape the degree evaluation committee and dissertation defense committee at the legal level by clarifying the boundaries and equal status of the two in the degree awarding,and designing a scientific and reasonable degree awarding procedure.
