摘　　要：《监察法》首次将腐败犯罪调查中的案件请示制度从工作纪律转化为法律规范。世界各国在腐败犯罪调查中形成了局部请示、裁量请示与强制请示三种制度模式。案件请示制度在我国最初采用党委领导下的局部请示模式,随后由检察机关建立了制衡性请示制度,监察体制改革将案件请示提升为基本调查原则。案件请示制度的正当性标准包括比例合理、程序正当与基本公正。监察调查案件请示制度在结构、功能与效果层面进行了优化,具有制度合法性;可从完善初核立案衔接的救济程序、上级监委与下级党委有效衔接以及请示后审批的标准体系补强合法性基础。The case request system in corruption crime investigation is from work discipline evolution into legal norms by Supervision Law for the first time. In the investigation of corruption crimes, countries around the world have generally formed three system models of partial request, discretionary request and compulsory request in corruption crime investigation. In the exploration stage, the partial request mode under the leadership of the party committee was established. Then, the procuratorial organs established the equitable request system. After the reform of supervision system, the case request was promoted to the basic investigation principle. The legitimacy of case request system consist of has source and standards. The source of legality explains the propriety, inevitability and necessity of the case request. The criterion of legality includes reasonable proportion, due process and basic fair. The supervision laws and regulations comprehensively optimized the case request system from structure, function and effect. The system of requesting instructions for supervision and investigation cases has been optimized in terms of structure, function, and effect, and has institutional legitimacy. Such as improving the remedy procedure of connecting the initial investigation and case filing, improving the effective connection between the supervisory commission at higher level and the party committee at lower level, and improving the standard system of request and approval.
