大数据侦查措施程序规制的困境与出路

摘　　要：大数据侦查作为一种新的侦查手段,加剧了公民权利干预的风险,有必要纳入程序规制的范畴。目前,大数据侦查措施的程序规制面临缺乏现行法律依据、传统规制机制“失灵”和数据运行隐蔽晦涩等困境。为此,应坚持立法与司法并行,在立法层面,将大数据侦查措施纳入法定的侦查措施体系,根据对公民个人信息权的干预程度分类进行规制,完善程序运行规则。在司法层面,引入外部监督力量,强化技术权限管理,改善内部自律为主的过程规制机制。为了保障程序规制机制能够发挥实效且流畅运行,应建立数据披露制度,并在侦查阶段引入专家参与人制度,打破程序运行中的技术壁垒。As a new investigation measure,big data investigation intensifies the risk of civil rights intervention,which is necessary to be included in the scope of procedural regulation.At present,the procedural regulation of big data investigation measures is in such dilemma as the lack of current legal basis,the“failure”of traditional regulation mechanism and the concealment and obscurity of data operation.Therefore,we should adhere to the parallel of legislation and judicature.At the legislative level,it is advisable to incorporate big data investigation measures into the legal investigation measure system,regulate according to the degree of intervention in citizens’personal information rights,and improve the procedural operation rules.At the judicial level,it shall be done to introduce external supervision,strengthen technical authority management,and improve the process regulation mechanism based on internal self-discipline.In order to ensure the effectiveness and smooth operation of the procedure regulation mechanism,we should establish a data disclosure system and introduce the expert participant system in the investigation stage to break the technical barriers in the procedure operation.
