摘　　要：With a consensual divorce,the spouses are recognized the natural freedom to dissolve their marriage as a manifestation of the general natural freedom of the person,as it is provided in Article 5.1 of the Constitution.Law 4509/2017 amended Articles 1438 and 1441 and the court procedure of consensual divorce was replaced by the consensual dissolution of the marriage with the agreement of the spouses ratified by a notarial deed,while Law 4800/2021 introduced the intangible electronic divorce by mutual consent.The divorce agreement initially includes the agreement for the dissolution of the marriage.The agreement of the spouses is not required to state the reasons that lead to the dissolution of the marriage.The legality of the agreement is ensured by the cooperation of the attorneys of the two parties,and in any case,if its content,especially with regard to the issues of minor children,indicates poor parental care,anyone with a family law interest or the prosecutor can request the court to take appropriate measures.
