论刑事侦查讯问过程中的律师在场权

摘　　要：随着以审判为中心的刑事诉讼制度改革不断加深,控辩双方的对抗性在庭审阶段得到了强化。然而,在侦查讯问过程中,控辩双方的对抗性仍显不足,极有可能导致侵犯犯罪嫌疑人人权的情况出现。侦查权的行使需要受到正当程序的约束。为构建侦查的正当程序以实现犯罪嫌疑人的人权保障,许多国家和地区实行了律师在场制度,试图以控辩平衡的维持达致前述目标。在新时代推进刑事治理体系现代化的进程中,有必要参酌域外法治经验,构建具有中国特色的律师在场制度。本文首先从基础概念入手,对律师在场权的内涵进行界定,然后廓清相关制度的理论基础与实践意义,继而就域外典型国家的制度进行引介与评价,最后基于前述材料提出我国律师在场制度的构建思路。With the deepened commitments to the trial-centered criminal procedures system reform,the adversary proceedings have been strengthened in the trial stage.However,in the process of investigation and interrogation,the adversarial nature between the prosecution and the defense is still insufficient,which may cause the violation of the human rights of the suspects.The investigation supervision should be enhanced by due process of law.In order to construct the due process of investigation to protect criminal suspects’human rights,many countries and regions have implemented the system of lawyers’presence,trying to achieve the aforementioned goal by maintaining the balance of the prosecution and the defense.In the process of promoting the modernization of the criminal governance system in the new era,it is necessary to refer to extraterritorial rule of law experience and construct the system of the presence of lawyers with Chinese characteristics.This paper starts with the basic concepts to define the connotation of the right of the lawyer’s presence,clarifies the theoretical basis and practical significance of relevant systems,and then introduces and evaluates the systems of typical countries outside the region.Finally,based on the above-mentioned materials,the author puts forward the constructive suggestions of the lawyer’s presence system in China.
