论第三人类型化调整视域下的诉讼告知

摘　　要：诉讼告知是指在诉讼中由特定案件的当事人向可参加诉讼的第三人告知案件已系属于诉讼的行为。司法实践中,我国民事诉讼长期处于缺乏诉讼告知的状态,而以第三人参诉制度取代之。诉讼告知的缺失已成为我国民事诉讼制度的较大缺陷。诉讼告知具有独特的功能,如一次性纠纷解决、维护告知双方权益和完善第三人权益救济程序等。大陆法系大多建立了诉讼告知制度以维护第三人合法权益,对此应当取其精华、去其糟粕。鉴于我国现存第三人制度已经饱受批驳,为防止造成更加混乱的局面,诉讼告知应当在第三人类型化调整之基础上加以建构,在此过程中也要结合具体国情,注意协调与现存诉讼制度的关系,以实现域外经验的本土化借鉴。Litigation notification refers to the act of informing a party in a particular case of a particular case to a third party who can participate in the litigation,that is,the informant,that the case has fallen under litigation.In judicial practice,Civil Litigation in China has long been in a state of lack of litigation notification,and it has been replaced by a third-party litigation system.The lack of litigation notification has become a major defect in China’s civil procedure system.Litigation notification has unique functions,such as one-time dispute resolution,safeguarding the rights and interests of both parties and improving the procedures for remedying the rights and interests of third parties.Most civil law countries have established a litigation notification system to safeguard the legitimate rights and interests of third parties,and they should take the essence and remove the dross.In view of the fact that China’s existing third-party system has been criticized and in order to prevent more confusion,litigation notice should be constructed on the basis of the adjustment of the type of third party,and in this process,it is also necessary to combine specific national conditions and pay attention to coordinating the relationship with the existing litigation system,so as to realize the localization of extraterritorial experience.
