摘  要:随着教育法治建设的发展,我国高等教育领域行政法问题研究经历了萌芽、发展、深化三个阶段,涌现了大量优秀的学术成果,总体呈现由实践推动到理论挖掘、由焦点关注到全面研究、由依托一般原理到构建部门理论的发展态势;但是,在高等教育行政法问题研究中仍存在缺憾,教育立法研究存有不足,教育行政行为研究并不全面、教育行政争议研究尚不充分。为了进一步推动研究的深入,未来应从强调高等教育领域立法研究聚焦、完善教育行政行为研究、回应新型教育行政诉讼案件、增强学科交叉融合研究等方面进行优化改进,以期构建成熟完善的高等教育问题研究体系,推动高等教育法治建设。With the development of legal construction in education,Chinese higher education germination,development,deepening administrative law problems researches have experienced three stages and have produced a large number of excellent academic achievements.To push the theory of mining by the general practice,by the focus on the comprehensive research,by relying on the development of the theory of general principles to build branch.However,there are still defects in the study of administrative law in the field of higher education,such as the shortcomings in the study of educational legislation,the incomplete study of educational administrative acts and the inadequate study of educational administrative disputes.In order to further promote the deepening of research,we should emphasizes the legislative research focus in the field of higher education,improve the research on educational administrative behavior,respond to the new cases of educational administrative litigation,and strengthen the research on interdisciplinary integration.In order to build a mature and perfect higher education research system and promote the legal construction of higher education.
