摘　　要：随着电子送达在民事诉讼实务中的广泛应用,数据使用规则、同意规则、“确认收悉”规则、裁判文书送达规则暴露的问题越发突出。为保障民事诉讼电子送达规则应用的逻辑自洽性和理论的周延性,应从涉诉主体个人数据合理限制的正当性、同意规则与“确认收悉”规则改造的必要性、重塑司法威严的重要性展开理论分析。从合理性与妥当性等方面考量规则的现实需求,依据权利保障与合理限制并举、适用主体的适当区分、多模式统筹推进、彰显司法威严的思路,构建收集送达地址数据的告知和安全保障规则,在区分适用“经同意”主体的基础上完善缺席审判规则,建立转交送达的电子化规则与妨碍送达的惩戒机制,同时将仪式感与尊严理念融入到裁判文书的电子送达规则中。With the wide application of electronic service in civil litigation practice,the problems exposed in the practice with data use rules,consent rules,“confirmation of receipt”rules and judgment document service rules are becoming more and more prominent.In order to ensure the logical self-consistency and theoretical extension of the application of electronic service rules in civil litigation,we should further carry out theoretical analysis from the legitimacy of the reasonable restriction to the personal data of the litigation subject,the necessity of the transformation of consent rules and confirmation of receipt,and the importance of reshaping judicial authority.Considering the practical needs of the rules from the aspects of rationality and appropriateness,and based on the ideas of simultaneous protection of rights and reasonable restrictions,appropriate differentiation of applicable subjects,overall promotion of multi-mode and highlighting judicial authority,we should further build the notification and security rules for the collection of service address data,improve the trial by default rules on the basis of distinguishing and applying“consent”subjects,establish the electronic rules of forwarding service and the disciplinary mechanism of hindering service,and integrate the sense of ceremony and dignity into the electronic service rules of judicial documents.
