摘　　要：法理是法学研究的中心主题,具有高度的概括性和统摄性。法理存在于历史传统之中,文学作品也是法理的重要载体。古典小说《西游记》堪称法律文化宝典,富含法理思想。在《西游记》中,神话人物动辄援引律条,“法度”“天条”“天理”“家法”“知理明律”“王法条律”等具有法理意蕴的词汇随处可见,书中更有法律与权威、法律与权利、法律与道德、法律与人性、法律与自由、法律与人情、法律与理欲、人治与法治、法律与宗教、法律与社会管理、法律与民约等典型法理命题的深邃思考。《西游记》的法理意涵是法律与文学交叉研究的典型个案,也为法理研究打开了新视野。Jurisprudence is the central theme of legal research with high generalization and domination.Jurisprudence exists in historical traditions,and literature works are also important carriers of jurisprudence.The classical novel Journey to the West is a treasure trove of legal culture since it is rich in legal thoughts.In Journey to the West the mythical characters invoke the legal provisions frequently,and such words with legal implications as“laws”,“rules in heaven”,“justice in heaven”,“family laws”,“knowing the rules and laws”,“laws of king”can be found here and there.Moreover,there are a variety of profound reflections on typical legal propositions in this novel,such as law and authority,law and rights,law and morality,law and human nature,law and freedom,law and human feelings,law and rational desire,rule of man and rule of law,law and religion,law and social management,law and civil contract,etc.The jurisprudence implications of Journey to the West constitute a typical case of the cross-over study of law and literature,which also opens up a new horizon for the study of jurisprudence.
