摘 要:游戏玩家的操作行为只有产生了独创性的效果才可以被认定为著作权法上的创作。游戏画面属于视听作品。基于视听作品的独创性来源,游戏玩家可能会在内容生成和画面拍摄两个方面做出独创性贡献。从内容生成来看,在非竞技类游戏中,玩家的操作更有可能生成具有独创性的新内容。从画面拍摄来看,只有玩家拍摄自制剧本,才能被认为操作行为对画面的拍摄做出了独创性贡献。It is only when the operation of game players produces original work that their behavior can be identified as an act of creation.Game graphics are classified as audiovisual works.Based on the source of originality of an audiovisual work,game players may make their contribution original in"content generation"or"image shooting".From the perspective of content generation,it is more likely for the game players′operation to generate original content in non-competitive games than others.In terms of image shooting,only when the player performs according to a self-made script,can the operation be recognized as originality.
