摘　　要：电子证据既存在与传统书证同样的真实性问题,即需要确认其制作者的真实性,以防伪造、捏造,更重要的是,还存在传统书证不涉及的同一性问题,即证据掉包或混入问题。电子证据同一性证明依赖于电子证据保管链的证明,电子证据保管链具有动态复合性,既涉及原始电子数据的保管链,又涉及呈述性电子数据的保管链。原始电子数据的保管链证明环节有原始电子数据的收集环节、原始电子数据的保管环节、原始电子数据的移送环节。呈述性电子数据保管链证明的环节包括呈述性电子数据发现环节和呈述性电子数据固定环节。刑事电子证据保管链的证明方式主要有笔录证明和证言证明等方式。与传统证据保管链的证明不同,笔录除纸质笔录外还包括电子笔录,证言除取证人员的证言外还包括见证人的证言。此外,原始电子数据和呈述性电子数据保管链证明适用的证明方法存在差异。Electronic evidence has the same authenticity problems as traditional documentary evidence, that is, it needs to confirm the authenticity of its producer to prevent forgery and fabrication. There is also a more important identity problem that is not involved in traditional documentary evidence namely evidence swapping or mixing. The proof of identity of electronic evidence depends on the proof of electronic evidence custody chain, which has dynamic complexity and involves both the chain of original electronic data and the chain of presenting electronic data. The proof link of original electronic data custody chain includes the link of original electronic data collection, the link of original electronic data custody and the link of original electronic data transfer. The link of presenting proof of electronic data custody chain includes the link of presenting electronic data discovery and the link of presenting electronic data fixation. The methods of proof of criminal electronic evidence custody chain mainly include written record proof, testimony proof and so on. However, different from the traditional proof of the chain of custody of evidence, the written record includes electronic records in addition to paper records, and the testimony includes the testimony of witnesses in addition to the testimony of forensic personnel. In addition, there are differences in the certification methods applicable to the original electronic data and the evidence presented in the electronic data custody chain.
