摘 要:我国《民法典》首次规定居住权制度,不仅丰富民法用益物权制度的体系,还促进为特定人群的住房需求提供保障目标的实现。但目前《民法典》中对居住权的规定显然不足,需要通过解释论和续造的方式加以解决。因此,从探寻居住权制度的起源及嬗变入手,阐述中国特色居住权制度之价值,分析存在居住权人主体和客体范围不清、以遗嘱方式设立的居住权登记制度规定的缺位、居住权之权利和义务内容规定匮乏的问题,提出丰富居住权人主体和厘清客体范围规定、增添以遗嘱方式设立的居住权登记制度规定、填补居住权制度之权利和义务内容规定之完善建议。China's Civil Code stipulates the residence right system for the first time,which not only enriches the system of civil law usufructuary right system,but also promotes the realization of the goal of providing security for the housing needs of specific groups.However,the current provisions on the right of residence in the Civil Code are obviously insufficient,which need to be solved by means of interpretation and continuation.Therefore,starting from exploring the origin and evolution of the residence right system,this paper expounded the value of the residence right system with Chinese characteristics,analyzed the problems existing in the unclear scope of the subject and object of the residence right holder,the absence of the provisions of the residence right registration system established by will,and the lack of provisions on the contents of the rights and obligations of the residence right,and put forward to enrich the subject of the residence right holder and clarify the provisions on the scope of the object,add the provisions of the residence right registration system established by will,and fill in the improvement suggestions on the provisions of the rights and obligations of the residence right system.
