粤港澳大湾区刑事合作新背景下内地与香港特区逃犯移交的底线思维与制度构建

摘　　要：香港回归后,内地与香港两地刑事司法协助则始终停滞不前,尤其是两地逃犯移交方面至今无法取得突破,个案移交亦不甚理想。随着粤港澳大湾区国家战略规划的提出,内地与香港两地的制度融合与规则衔接将迎来重大突破,两地逃犯移交问题也再次成为探讨两地刑事司法合作新模式的突破点。在这一背景之下反观内地与香港特区逃犯移交问题上依然存在多种困境:法理困境、管辖权困境。在牢牢把握“一个中国”的底线原则基础上,摸索国际引渡原则与双重犯罪原则的适度展开,同时处理好刑法空间效力与刑事管辖权关系,并借助粤港澳大湾区战略背景的重要机遇,把握《前海方案》与《横琴方案》所提供的粤港澳三地刑事司法合作新路径,鉴于“求同存异”“先例”效应、区际司法协助三方面的现实基础,整合粤港刑事司法合作的现实基础,推动粤港逃犯移交个案合作试点,最终形成较为稳定的移交机制。After Hong Kong's reversion,the Ratify the Treaty on Judicial Assistance in Criminal Matters between the China's mainland and Hong Kong still has no pogress,especially in Fugitive Transfer between two places,there is no ideal individual case yet.With the purpose of the National Strategic planning of the Guangdong-Hong Kong-Macao Greater Bay Area,there will be a major breakthrough in the integration of law systems and rlues between two areas,the Fugitive Transfer has once again become a breach in exploring new models of Criminal Cooperation in two areas.Under this background,there are jurisprudetial dilemma,jurisdictional dilemma and public dilemma on the Fugitive Transfer.Based on“One-China”,to explore the Moderate Development of the Principles of International Extradition and Double Criminality,handling the relationship between the space effect of criminal law and criminal jurisdiction,making good use of the National Strategic planning of the Guangdong-Hong Kong-Macao Greater Bay Area,grasping the new path for Criminal Cooperation among Guangdong-Hong Kong-Macao offer by Comprehensive Deepening Reform and Opening Up of the Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone and General Construction Plan for Hengqin Guangdong-Macao In-depth Cooperation Zone.Based on the spirit of seeking common ground,“precedent effect”and interregional judicial assistance between the mainland and Hong Kong,intergrating the realistic basis of Criminal Cooperation in two areas,promoting the pilot for Guangdong and Hong Kong fugitives hand over and forming a stable handover system at last.
