摘　　要：近年来,我国自然垄断行业竞争性业务开放持续推进。自然垄断行业竞争性业务的开放并不只是放松或取消竞争性业务的进入和价格监管,还需要健全竞争性业务开放的保障制度,从而构建公平有效的市场竞争环境,确保竞争性业务开放的效果。我国自然垄断行业竞争性业务开放的保障制度完善,一是健全具体的行业性法律法规体系,强化与自然垄断行业政府监管相关的法律法规的针对性,为竞争性业务开放奠定法律基础;二是加快国有企业混合所有制改革步伐,继续优化民营企业参与的竞争环境,从而保证各种所有制经济平等竞争;三是优化自然垄断行业的政府监管机构,进一步明确监管职能并完善监督机制,保障市场竞争的公开公平公正。In recent years, the opening of competitive business in China’s natural monopoly industries has been continuously promoted. The opening of competitive businesses in natural monopoly industries does not only mean relaxing or canceling the entry and price regulation of competitive businesses, but also requires perfecting the guarantee system of competitive business opening, so as to build a fair and effective market competition environment and ensure the effect of competitive business opening. The guarantee system for the opening of competitive business in China’s natural monopoly industry should be improved from the following three aspects. Firstly, we should perfect the specific industrial laws and regulations system, and strengthen the pertinence of laws and regulations related to the regulation of natural monopoly industry, so as to lay a legal foundation for competitive business opening;Secondly, we should accelerate the reform of mixed ownership of state-owned enterprises, and continue to optimize the competitive environment for private enterprises, so as to ensure the equal competition of various ownership economies;Thirdly, we should optimize the regulatory agencies of natural monopoly industries, further clarify the regulatory functions and improve the supervision mechanism, so as to ensure the openness, fairness, and justice of market competition.
