摘　　要：介绍全国首例微生物专利侵权案件,即上海丰科纯白真姬菇菌株侵权案,上海丰科诉被告未经许可生产并销售涉案专利产品,侵害了其专利权。北京知识产权法院受理此案,并通过专业鉴定,作出支持判决。通过研究分析该起案件,论述目前微生物菌株专利保护范围划定方法的不足,探讨食用菌易被侵权类型和国外可借鉴的做法。介绍潜在可用的株系鉴定方法,并针对解决侵权判定难题提出技术性建议。This paper introduces the first microbial patent infringement case in China,that is,the infringement case of Shanghai Fengke white Hypsizygus marmoreus strain.Shanghai Fengke sued the defendant for producing and selling the patented products involved without permission,infringing its patent rights.The Beijing Intellectual Property Court accepted the case and made a supporting judgment through professional appraisal.Through the research and analysis of this case,the insufficiency of the current method of delimiting the scope of patent protection for microbial strains is discussed,and the types of edible mushroom that are easily infringed and the practices that can be used for reference abroad are discussed.Introduced potential strain identification methods,and make technical suggestions for solving the problem of infringement determination.
