摘　　要：国际投资仲裁既是一种程式化的活动,亦是一种文化实践。仲裁庭在应对争端方所提出的腐败抗辩时,文化理解与文化挑战已变为仲裁程序无法回避的争论议题。着力于国际投资仲裁程序中文化代表性的地域平衡与非西方法律传统仲裁员的能力建设,为国际投资仲裁语境下的腐败判定设置严格法律标准,以及创设国际投资仲裁机构与内国国家机关间的反腐协作机制是国际投资仲裁反腐实践中应对文化挑战的“良法善治”路径探索。International investment arbitration is not only a ritualized activity,but also a cultural practice.When arbitral tribunal deals with the corruption defense raised by the disputing parties,cultural understanding and cultural challenges have become unavoidably controversial issues in the arbitration procedure.Focusing on the geographical balance of cultural representation in international investment arbitration procedures and the capacity-building of non-western legal traditional arbitrators,and the imposition of strict legal standard for judging corruption in the context of international investment arbitration,as well as the creation of anti-corruption coordinative mechanisms between international investment arbitration institutions and domestic authorities are the exploration of“good law and good governance”approach to settling cultural challenges in anti-corruption of international investment arbitration.
