摘 要:我国宅基地使用权流转制度经历了自由流转、变相流转以及当下限制流转三个时期。随着一系列政策的出台,国家积极鼓励对宅基地资源进行盘活利用,以求达到增加农民财产性收入的目的。但当前地方试点多以政府为主导,容易忽略农民诉求与主观意愿且未能显著增加财产性收入。对此,妥适的解决之道可采内外有别的宅基地使用权流转方案,内部可以向符合条件的本集体成员流转;外部流转发生在村民将农宅对外出售后,由取得农宅所有权的外部主体向集体申请临时使用宅基地。The circulation system of homestead use right in China has experienced three periods:free circulation,disguised circulation and current restricted circulation.With the introduction of a series of policies,the state actively encourages the active utilization of homestead resources in order to increase farmers’property income.However,at present,local pilot projects are mostly dominated by the government,which is easy to ignore farmers’demands and subjective wishes,and fail to significantly increase property income.In this regard,the appropriate solution can be the transfer scheme of the use right of other homesteads inside and outside,which can be transferred internally to the qualified members of the collective.The external circulation occurs after the villagers sell the rural house,and the external subject who has obtained the ownership of the rural house applies to the collective for the temporary use of the homestead.
