环境民事公益诉讼中检察机关调查取证权的运行机制探析

摘　　要：在检察机关参与环境民事公益诉讼的过程中,调查取证权的运行机制无疑是其有效推进诉讼全流程以及保证诉讼效果的核心要件。通过明确检察机关调查取证权的运行原则,细化检察机关调查取证权的运行要件,规范检察机关调查取证权的运行程序以及加强检察机关调查取证权的运行效力,构建起系统的检察机关调查取证权运行机制,进而保障检察机关调查取证权与参诉职能定位相匹配,从而推进我国检察环境公益诉讼机制发展与生态文明制度建设相协调。In the process of procuratorial organs participating in environmental civil public interest litigation,the operation mechanism of the investigation and evidence collection power of procuratorial organs is undoubtedly the core element to effectively promote the whole process of litigation and ensure the effect of litigation.Through clarifying the operation principles,refining the operation elements,standardizing the operation procedures,and strengthening the operation effectiveness,a complete operation mechanism of the investigation and evidence collection power of the procuratorial organs will be constructed,so as to give full play to its preset function,and then to realize the ultimate goal of procuratorial environmental civil public interest litigation mechanism.
