摘　　要：近年来诉讼案件年终受理问题日益引起社会的关注。本文立足于C市基层法院年终受理案件的具体情况,通过实证研究的方法找出问题、分析原因、寻求对策。实证调研发现,由于考核指标缺乏科学性、受案量与办案人员数量严重失衡、诉前调解与延期审理缺乏法律依据、批量案件寻求“首例判决”等原因。法院年终具有案件量大、结案率指标高、受案与结案圈层不均等特征,面临着大量“新兴案件”涌入、繁简分流效能遭遇瓶颈、送达难以及旧存案件“一延再延”等问题。对此应科学设立立案结案的考核指标,法院人案配置“以案定额”,对“新兴案件”立案审理应当遵循“适宜性”原则,明确规定诉前调解的一般时限与上限,设立当事人辅助送达制度,进一步规制延期审理并反思现有审理期限的“单一性”。In recent years,the issue of year-end acceptance of litigation cases has attracted increasing attention from the society.Based on the specific situation of yearend acceptance of cases in C city basic courts,this paper identifies the problems,analyzes the causes and seeks countermeasures through the method of empirical research.The empirical research finds that due to the lack of scientific assessment index,the serious imbalance between the number of cases received and the number of case workers,the lack of legal basis for pre-litigation mediation and postponement of trial,and the search for"first judgment"in bulk cases.At the end of the year,the court has a large number of cases,high completion rate indicators,unevenly received and closed circle and other characteristics,facing a lar ge number of"emerging cases"influx,the effectiveness of simple and complicated diversion encountered bottlenecks,service difficulties and old cases"delayed repeatedly"and other problems.In this regard,the scientific establishment of the assessment indicators for the completion of the case,the court case configuration"to case quota",the"emerging cases"should follow the"suitability"principle,clearly stipulate The court should follow the principle of"appropriateness"for"emerging cases",specify the general time limit and upper limit of pre-litigation mediation,establish a party-assisted service system,further regulate the postponement of trial and reflect on the"unity"of the exis ting trial period.
