新《海上交通安全法》关于船员权益保障与管理的制度解读

摘　　要：新修订的《海上交通安全法》是对我国现行船员法律体系的补充完善,其在船员权益保障与管理方面增加了国际航行船舶的海事劳工证书许可、船员权益财务担保、船员境外突发事件预警和应急处置等多项船员权益保障制度,完善了船员持证管理、船长管理指挥船舶的权利义务、船员法律责任等制度。The newly-amended Maritime Traffic Safety Law serves as a supplement to the existing legislation system for seafarers in China.In terms of seafarers’rights protection and management,the newly amended law includes many mechanisms to gurantee seafarers’rights and interests,such as the license system for the maritime labour certificate of international voyage vessels,the financial guarantee for seafarers’rights and interests,the early warning and emergency response mechanicams for overseas emergencies of crew members.It also improves the management of seafarers’holding certificates,the rights and obligations for the master in managing and commanding the ship,the legal liabilities of crew members,etc.
