知情同意与医患共同体的道德治理

摘　　要：医患关系本质上是以共同体形式出现的,然而,医患共同体的断裂已成为不可忽视的公共危机,它表现为医患信任的瓦解与共同体“善”的流失。在政府与市场共同作用下,构建共同体治理机制也是我们回应医患危机的重要出路。知情同意是生命伦理学原则,统合了患者权利与医者义务,成为形塑现代医患共同体的公共机制。从治理角度阐释知情同意,既是对医患关系现状与社会治理能力的反思,更是对知情同意功能的延展。知情同意与道德治理在医患共同体中的汇通,根源于知情同意的道德基础、问题视域与价值理念,其实践必须依托于患者参与、医患理性协商与知情同意的公共制度安排。Essentially,the doctor-patient relationship appears in the forms of community.However,the disruption of doctor-patient community is becoming a public crisis that cannot be ignored,which illustrates the collapse of the doctor-patient trust and the loss of good of the community.Under the concerted efforts made by market and government,nurturing the governance mechanism becomes the important issue to deal with the doctor-patient crisis.Informed consent is an important principle in bioethics,which integrates the rights of patients and the obligations of physicians,and become the public mechanism shaping the modern doctor-patient community.To explore the principle of informed consent from the perspective of governance is not only a reflection on the status quo of doctor-patient relationship and social governance capacity,but also an extension of the function of informed consent.The convergence of informed consent and moral governance in the doctor-patient community is rooted in the moral basis,problem horizon and value system of informed consent.Therefore,for practice,it must rely on patient’s engagement,rational consultation between physician and patient,and the public institutional arrangement of informed consent.
