摘　　要：档案信息公开工作是档案治理现代化建设的重要部分。近年来,因档案信息公开引发的争议层出不穷,行政诉讼案件数量日益增多。通过对近9年来109起案件分析可知,档案信息公开行政诉讼存在原告滥用诉权,原告资格与受案范围较为模糊,档案馆、档案局与人民政府在信息公开中的主体地位与法律责任不明,信息公开与否缺乏明确依据,档案馆、档案局存在一定程度不作为等问题。未来应当建立健全档案信息公开滥诉行为的判断标准与规制方案,厘清原告资格与受案范围的标准,明确“以公开为原则,以保密为例外”的档案信息公开原则,明确相关主体的法律地位与工作职责,促使政府信息公开与档案信息工作协调顺畅。Archival information disclosure is an important part of the modernization of archives management.In recent years,disputes arising from the disclosure of archival information have emerged in an endless stream,and the number of administrative litigation cases is increasing day by day.Through the analysis of 109 cases in the past nearly nine years,it can be seen that there are some problems in the administrative litigation of archival information disclosure,such as the plaintiff’s abuse of litigation right,the plaintiff’s qualification and the scope of accepting cases are relatively vague,the principal position and legal responsibility of archives,archives bureau and people’s government in information disclosure are unclear,there is a lack of clear basis for information disclosure,and archives and archives bureau do not act to a certain extent.In the future,we should establish and improve the judgment standards and regulation schemes for the abuse of litigation in the disclosure of archival information,clarify the standards for the qualification of plaintiffs and the scope of accepting cases,clarify the principle of archival information disclosure with "openness as the principle and confidentiality as the exception",clarify the legal status and work responsibilities of relevant subjects,and promote the smooth coordination between government information disclosure and archival information work.
