侦查讯问阶段律师在场制度构建研究

摘　　要：讯问作为侦查机关获取犯罪证据的重要手段,是构建证据链条、破获案件的关键环节,可同时也是犯罪嫌疑人的合法权益极易受到侵害的敏感地带,实务中出现诸多刑讯逼供造成的冤假错案,也揭示加强对审讯环节的监督和对犯罪嫌疑人的人权保护的必要性。随着我国法治建设的不断进步,律师在场制度在我国已具备现实可行的条件和契机。为有效遏止程序违法现象,就需要在敏感而关键的侦查讯问阶段,通过律师的有效参与解决侦查讯问环节权力配置过度失衡的问题。文章从适用范围、机制安排、程序设计以及保障机制四方面,对于侦查讯问阶段的律师在场制度进行了详细论述,以期更好保证程序正义以及人权保障等立法目的得到有效实现。Interrogation,as an important means for investigation organs to obtain criminal evidence,is a key link in constructing the evidence chain and solving cases.It is also a sensitive area where the legitimate rights and interests of criminal suspects are vulnerable to infringement.In practice,many unjust,false and wrong cases which are caused by inquisition by torture reveal the necessity of strengthening the supervision of interrogation and the protection of human rights of criminal suspects.The continuous progress of legal construction in China has provided practical conditions and opportunities for the lawyer presence system.In order to effectively curb the breach of procedural laws,at the sensitive and critical investigation and interrogation stage,it is necessary to solve the problem of excessive imbalance of power allocation in the investigation and interrogation process through the effective participation of lawyers.Specifically,from the four aspects of application scope,mechanism arrangement,procedure design and guarantee mechanism,the lawyer presence system at the investigation and interrogation stage is discussed in detail,so as to better ensure the effective realization of legislative purposes such as procedural justice and human rights protection.
