摘 要:认罪认罚制度试行至今,已经初步实现推动繁简分流、简案快办、难案精办,统一推进效率和公正的目标。然而,上诉、抗诉比例的上升必然导致审判周期的延长和司法资源的浪费,这是与制度的初衷背道而驰的。检察机关作为认罪认罚制度的主导机关,其行为对认罪认罚制度的发展具有重要影响。因此,在推进认罪认罚制度落实的过程中,应当规范检察机关抗诉权的行使。目前,抗诉权行使的法理基础薄弱、法律依据欠缺,也是其受到质疑的主要原因。另外,抗诉权行使中还存在标准笼统、抗诉后程序规定欠缺、风险防范体系不完善等问题。对此,需要采取相应措施积极加以完善。Since the trial of guilty plea system,it has initially achieved the goal of promoting the separation of complex and simple cases,quick handling of simple cases,fine handling of difficult cases,and unified promotion of efficiency and justice.However,the rise of appeal and protest will inevitably lead to the extension of trial cycle and the waste of judicial resources,which is contrary to the original intention of the system.As the leading organ of the system of guilty admission,the procuratorial organ's behavior has an important influence on the development of the system of guilty admission.Therefore,in the process of promoting the implementation of the system of guilty plea,we should standardize the exercise of procuratorial organs'right of protest.At present,the weak legal basis and lack of legal basis for the exercise of the right of protest are also the main reasons for its being questioned.In addition,there are some problems in the exercise of protest right,such as general standard,lack of post-protest procedure and imperfect risk prevention system.In this regard,we need to take corresponding measures to improve actively.
