高校职务犯罪案件查办协作配合工作机制研究

摘　　要：高校纪检监察体制改革稳步推进,高校职务犯罪案件查办协作配合工作呈现强化态势,但理论研究尚显滞后。从工作中监察机关与公检法等机关配合现状出发,深入分析其中诸如对监察权认识不足,存在消极配合的现象;协作机制不够完善,程序性规定亟待细化;法法衔接不够顺畅,纪法衔接不够贯通等协作配合工作机制问题,要树立新时代法治反腐理念,健全案件协作配合机制、纪法衔接机制、案件考核评价机制,以健全高校职务犯罪案件查办协作配合工作机制。The reform of discipline inspection and supervision system in colleges and universities is advancing steadily and the cooperation in Investigating duty crimes cases in colleges and universities shows a strengthening trend,but the theoretical research is still lagging behind.By elaborating the current situation of cooperation between the department of discipline inspection and supervision in colleges and universities and Public Security Bureau,the People’s Procuratorate,the People’s Court and other departments,this paper analyzes the problems of the cooperation mechanism of Investigating duty crime cases in colleges and universities in-depth such as insufficient understanding of the supervisory power,the phenomenon of negative cooperation,imperfect cooperation mechanism,procedural rules to be refined and lack of coherence in the connection between the discipline and the law.Therefore,it puts forward some suggestions on establishing the concept of rule of law and anti-corruption in the new era,improving the cooperation mechanism of Investigating duty crimes cases,the connection mechanism between the discipline and the law and the mechanism of case evaluations to Investigating improve the cooperation mechanism of Investigating duty crimes cases in colleges and universities.
