摘  要:法律诊所教育(Legal Clinic Education,CLE)已成为世界各地大学法律教育课程当中一个日益普遍的特征。这一领域的发展带动了专业期刊和会议上相关学术文献的发展,但其中大部分论述都是实用主义和实践导向的,缺乏在更广泛的意义上,开展与这一学术实践领域相关的理论问题的讨论。本研究通过思考市场化和公费法律咨询及代理的缩减这样两个新自由主义政策驱动因素的影响,分析了CLE在英国的发展过程,考察了上述政策如何导致了CLE文献实践导向型研究重点的形成,认为今后应把理论问题放在更加突出的位置上,从而促进诊所法律教育研究文献更加丰富。Legal Clinic Education(CLE)has become an increasingly common feature in legal education courses in universities around the world.The development of this field has led to the development of related academic documents in professional journals and conferences,but most of the academic discussions are pragmatic and practice⁃oriented,which lack of theoretical discussions on the issues related to this academic practice field in a broader sense.This study analyzes the development process of CLE in the United Kingdom and investigates the formation of the CLE literature practice⁃oriented research highlights that are brought about by the aforesaid policy.The study also weight the influence of two neoliberal policy driving factors,such as marketization and the reduction of publicly funded legal consulting and agency.This study puts forward that theoretical issues should be placed in a more prominent position in the future,so as to promote the enrichment of clinical legal education research literature.
