摘　　要：统一的举证责任分配原则亟待探索和确立。举证责任分配原则应当基于公正效率的程序价值和证据分布规律确立。行为控制规律是证据的分布规律,行为或行为对象的控制者应当证明其行为或行为对象或二者关系的事实符合对其有利的实体法的规定,即控制者自证其当。The unified principle of allocating burden of production needs to be explored and established urgently.Allocation of burden of production should be established based on the procedural value of justice and efficiency as well as the regular pattern of evidence distributions.The regular pattern of evidence distributions is the law of behavior controlling.The controller of the behavior or the object of behavior should adduce that the facts of his behavior or the object of behavior or the relationship between the two conform to the provisions of the substantive law beneficial to him,that is,the controller should self-prove his behavior being just.
