诉源治理下的温州金融ADR机制优化路径

摘　　要：作为金融改革的先行者,温州在金融创新方面走在全国前列,同时也带来了新型的矛盾和多样的纠纷。在诉源治理方面,作为“枫桥经验”的发源地,浙江省进行的一系列改革初见成效。依托全省社会治理现代化建设和基层社会矛盾纠纷调处化解中心的设立,金融矛盾治理迈向新阶段。温州金融ADR机制是诉源治理工作的一部分,党委和政府的领导则提供了软件上的支持,“一站式”解决问题的矛调中心为金融ADR机制提供了硬件上的优化。针对温州金融纠纷的特点和解决机制存在的问题,提出在矛调中心基础上优化温州金融ADR机制的建议。As a pioneer city of financial reform,Wenzhou is in the front rank of financial innovation in China.Meanwhile,new types of contradictions and diverse disputes arise.In terms of litigation source governance,as the birthplace of the“Fengqiao Experience”,a series of reforms carried out by Zhejiang Province have achieved initial results.The governance of financial contradictions has moved towards a new stage,based on the modernization of social governance and the establishment of the grass-roots social contradiction and dispute mediation and resolution center of the whole province.Wenzhou ADR mechanism for the financial disputes is a part of the litigation source governance work.The“one-stop”conflict resolution centre provides hardware optimization for the ADR mechanism,with the software support from CCP and government.In view of the characteristics of Wenzhou financial disputes and the problems existing in the resolution mechanism,the proposal is put forward to optimize the Wenzhou ADR mechanism for financial disputes on the basis of the conflict resolution centre.
