基于扎根理论的湖南省30家三级医院法治建设案例研究

摘　　要：目的:探讨三级医院法治建设的关键要素和推进医院法治建设的可能路径。方法:应用扎根理论和多案例研究,对获得的30家湖南省三级医院法治建设的文本资料进行三级编码分析,构建湖南省三级医院推进医院法治建设路径。结果:工作机制、领导机构、工作机构、法律顾问、法治意识、依法治院、纠纷处理、内外协作、考核评估等9个核心范畴是推进医院法治建设的关键要素。结论:三级医院可以按照建立医院法治组织机构、建立医院法治工作机制、推行医院法律顾问制度、全面推进依法治院、提升医院工作人员法治意识、依法进行纠纷处理、加强院内外机构合作、强化医院法治建设评估等8个方面推进医院法治建设。Objective:To explore the key elements of hospital legal construction in Grade Ⅲ hospitals and the possible paths to promote hospital legal construction.Methods:Applying grounded theory and multi-case study,the obtained text data of hospital legal construction in 30 Grade Ⅲ hospitals in Hunan Province were analyzed by three-level coding,and the path of promoting the hospital legal construction was constructed.Results:The nine core categories of working mechanism,leading organization,working organization,legal counsel,awareness of the rule of law,governing the hospital according to law,dispute resolution,internal and external cooperation,and assessment and evaluation were the key elements to promote the construction of the rule of law in the hospital.Conclusion:The Grade Ⅲ hospital can be based on the establishment of the hospital legal organization,the establishment of the hospital legal work mechanism,the implementation of the hospital legal counsel system,the comprehensive promotion of the hospital legal system construction,improve the legal awareness of hospital staff,resolve disputes in accordance with the law,and strengthen cooperation between internal and external institutions.Eight key points in the evaluation of the construction of the rule of law in the hospital to promote the construction of the rule of law in the hospital.
