摘　　要：妨害国境卫生检疫罪薄弱的罪刑理论和缺失的司法适用经验,影响国境卫生检疫执法工作开展。因此,厘清此罪立法背景,明确妨害国境卫生检疫罪在罪刑理论构建上的难题和司法适用中的困境,有利于发挥刑事司法对国家边境公共卫生安全的有力保障。在此罪的构成要件符合性判断中,需要明确此罪的实质结果犯样态,从司法角度把握严重危险性的认定;坚持医学评估和法律规范相结合方式,判断此罪的行为主体的适格性;明确故意行为人的主观犯罪认定标准。正确区分司法实践中本罪与其他相关犯罪的界限,有效实现本罪的刑罚目的。The weak criminal theory and the lack of judicial application experience affect the implementation of frontier health and quarantine law enforcement.Therefore,on the basis of clarifying the legislative background of this crime,clarifying the difficulties in the construction of crime and punishment theory and the dilemma in judicial application of the crime of obstructing border health and quarantine in our country,it is conducive to giving full play to the powerful guarantee of criminal justice for national border public health security.In the judgment of conformity of the constituent elements of this crime,it is necessary to clarify the substantive result of this crime,and grasp the determination of serious danger from the judicial point of view;the combination of medical evaluation and legal norms should be adhered to determine the eligibility of the subject of this crime;the behavior should be clear;the subjective sin is regarded as intentional purpose,and there is no case of negligence.In judicial application,it is crucial to distinguish the boundary between this crime and other crimes related to the prevention and treatment of infectious diseases,and to effectively realize the purpose of this crime.
