海量证据审查机制的制度化构建--以电信网络诈骗犯罪为视角

摘　　要：现阶段以电信网络诈骗犯罪为代表的信息网络犯罪,具有明显的涉众化特征,由此带来了证据体量巨大的问题。信息网络犯罪的主要证据类型为电子数据,由于涉及到非结构化、半结构化的多源异构数据等技术性问题,现有的处理工具难以对其有效处理。较大的技术处理难度和海量的证据体量相结合,是当下检察机关工作人员办理信息网络犯罪案件所面临的最大难题。因此,以电信网络诈骗犯罪为切入点,以检察机关的证据审查工作为视角,针对现阶段应对海量证据的处理方式,在充分肯定简化证明思路对网络犯罪证据审查工作的积极贡献的同时,应综合审视其利弊,优化传统证据审查思路,树立证据审查技术革新理念,加强检技协同和合作,研究海量证据人工智能的审查路径,力求建构具有可操作性的海量证据审查问题应对机制。Currently,the information cybercrime represented by the telecom network fraud has the obvious characteristic of involving a large number of people,which brings about the problem of massive evidence.The main type of evidence involved in information cybercrime is electronic data,which is difficult to handle effectively due to the technical problems such as non-structured,semi-structured multi-source heterogeneous data.The combination of the hugetechnological difficulty and the massive evidence is the trickiest problem faced by the staff of the procuratorial organs in handling information cybercrime cases.Therefore,from the perspective of the evidence review work of procuratorial organs and in view of the present treatment of massive evidence,we shall taketelecom network fraud as a breakthrough to affirm the positive contribution of simplifying the process of proof to cybercrime evidence review work.Meanwhile,we shall evaluate its advantages and disadvantages comprehensively,optimize the traditional evidence review process,build innovation idea about evidence review technology,strengthen the collaboration and cooperation with procuratorial techniques,work on the artificial intelligence review of massive evidence,and strive to set up operationalresponse mechanism on the review work of massive evidence.
