认罪认罚从宽视阈下量刑建议再审视

摘　　要：量刑建议权作为检察机关求刑权的一个分支,对于实现准确量刑、提高诉讼效率和人权保障都具有重要的价值。2021年,最高人民检察院出台《人民检察院办理认罪认罚案件开展量刑建议工作的指导意见》,较为系统和完善地规定了认罪认罚从宽制度下量刑建议的相关内容。在认罪认罚从宽制度之下,量刑建议不再仅仅是公诉机关行使职权的体现,亦是控辩双方协商成果的体现,在《刑事诉讼法》第201条“一般应当采纳”条款的规制下,量刑建议对法院终局裁决也具有重要的影响。对于量刑建议的研究,应从其作出方式、适用范围、效力等方面着手。对量刑建议规范化的路径建构,需要注重审前协商阶段律师的实质性介入,对量刑建议的提出方式与范围等方面进行系统规制,还应完善检察机关的相关应对措施。As a branch of the procuratorial authority’s right to seek punishment,the power of sentencing recommendations is of great value for realizing accurate sentencing,improving the efficiency of litigation,and protecting human rights.The Guiding Opinions systematically and comprehensively stipulate and sort out the relevant content of sentencing recommendations under the leniency system for confessing guilt and punishing punishment.Under the system of plea guilty and punishing leniency,"new elements"have been injected into the sentencing recommendation.The sentencing recommendation is not only a manifestation of the exercise of power by the public prosecution agency,but also a manifestation of the results of the negotiation between the prosecution and the defense.Under the regulation of the"adoption"clause,the sentencing recommendations also have an important impact on the court’s final decision.For the research of sentencing recommendations,we should start with the methods,scope of application,and effectiveness.The construction of the path to the standardization of sentencing recommendations requires attention to the substantial intervention of lawyers in the pre-trial negotiation stage.The method and scope of sentencing recommendations should also be systematically regulated,and the relevant response measures of the procuratorial organs should be improved.
