教育行政执法“局队合一”体制改革研究

摘　　要：当前,我国教育行政执法中存在的主要问题有:执法专业化程度偏低,跨部门联合执法难以形成整合机制,委托执法责权不清晰,运动式执法和专项治理缺乏持续性。《法治政府建设实施纲要(2021-2025年)》提出行政执法要实行“局队合一”的体制,该体制有利于教育行政执法责权统一以及教育行政执法专业化与制度化。进行“局队合一”的教育行政执法改革,有必要构建“教育行政部门为主、督导机构辅助”的教育执法主体模式,构建以教育行政部门内部综合执法为主、外部联合或协作为辅的综合执法运行框架,实行教育行政部门常态化执法为主、运动型执法为辅的机制,区分教育行政刑罚与刑事罚,并加强教育行政执法裁量基准建设。At present,the main problems existing in China’s educational administrative law enforcement are the low degree of specialization of law enforcement,the difficulty in the formation of integrative mechanism in the cross-department joint law enforcement,the ambiguity in the rights and obligations of entrusted law enforcement,and the inconsistency in the campaign enforcement and targeted governance.proposes that administrative law enforcement should implement the system of“integration of bureaus and teams”.The implementation of this system is conducive to the unification of responsibility and power of educational administrative law enforcement,and to the specialization and institutionalization of educational administrative law enforcement.To implement the“integration of bureaus and teams”system,it is necessary to construct the main body model of educational law enforcement,which is dominated by educational administrative departments and assisted by supervisory institutions.The framework of comprehensive law enforcement should be constructed,which is dominated by the internal law enforcement and supplemented by the external alliance or cooperation.The mechanism should be implemented with the regular law enforcement of educational administrative departments as the primary method and the sport law enforcement as a supplement.And at the same time,it is necessary to distinguish between educational administrative penalty and criminal penalty,and strengthen the criterion construction of educational administrative law enforcement.
