摘　　要：国家考试职务回避制度是保护考生利益,减少考试作弊,彰显法律教育意义的国家考试制度之一。我国拥有悠久的考试职务回避历史,在依法治考背景下,理应建立符合当代国情的考试职务回避制度。建立考试职务回避制的前提是以理论构建为基础,探究其理论、法律依据,明确界定“利害关系人”,关键是制定并完善考试职务回避制度体系、明确并细化工作程序、强化并执行责任追究。考试职务回避的效力,应区别考试工作人员主动申请回避、考生及其家长申请考试工作人员回避、考试工作人员应当回避而没有申请回避三种情形。The national examination job avoidance system is one of the national examination systems that protect the interests of candidates,reduce examination cheating,and highlight the education significance of laws.Our country has a long tradition of job avoidance in national examination.Under the background of administering the exam according to law,we should establish an examinational job avoidance system in line with contemporary national conditions.The premise of establishing the national examinational job avoidance system is theoretical construction,and the key is to improve the system,refine working procedures,and implement accountability.The effectiveness of national examinational job avoidance should be distinguished from three situations:examination staffs actively apply for avoidance,candidates and their parents apply for the avoidance of examination staff,and examination staff should avoid but did not apply for avoidance.
