论民事庭审录音录像的证据功能

摘　　要：民事庭审录音录像制度的产生与发展受辅助庭审笔录制作、助力审判公开、建设科技法庭和促进案件繁简分流等多重因素的推动。在民事庭审录音录像与庭审笔录准并行模式之下,其可作为证据使用,并具有过程证据和结果证据的双重功能。作为过程证据时,民事庭审录音录像可用于证明庭审程序规范与否、当事人诉讼过程中的状态。作为结果证据时,民事庭审录音录像可用于证明本案事实或另案事实。对民事庭审录音录像证据,人民法院应坚持实质审查为主、形式审查为辅的审查原则。民事庭审录音录像证据功能的发挥需要保障申请人的获取权,并规范民事庭审录音录像的录制。The emergence and development of audio and video recording of civil trials was driven by multiple factors,such as assisting the preparation of trial transcripts,helping the publicity of trials,building up scientific and technological courts,and facilitating separation of complex and simple cases.Under the quasiparallel modes of video recording and written trial transcripts of civil trials,it can be used as evidence,and has the dual functions of process evidence and result evidence.As process evidence,audio and video recording of civil trials can be used to prove whether the court trial proceeding is standardized or not,and the status of the parties during the trial.As result evidence,it can be used to prove the facts of the case at issue or other cases.With regard to examining the audio and video recording evidence of civil trials,the People’s courts shall adhere to the review principle of giving priority to substantive review and supplementing formal review.To fulfill the functions of audio and video evidence of civil trials,it is necessary to protect the applicants’right of obtaining,and regulate the recording process.
