检察机关提起环境民事公益诉讼诉前程序探析

摘　　要：检察机关提起环境民事公益诉讼诉前程序是我国环境保护领域的重大进展,其在完善我国环境公益诉讼制度和增强环境保护有效治理方面发挥着重要作用。但从司法实践来看,诉前程序尚存在各主体顺位衔接不畅、调查核实权运行机制不完善、履职方式较为单一等问题,影响其程序价值的实现。从立法与司法实务现状出发,提出了明确界定权利行使顺位、理顺各主体间工作衔接机制、细化调查核实权运行的程序规则、探索灵活多样的新型履职方式等对策和建议,以期促进我国诉前程序的完善与发展,实现诉前程序保护环境公共利益的最大化。The pre-litigation procedure of environmental civil public interest litigation initiated by procuratorial organs is a major progress in the field of environmental protection in China,which plays an important role in improving China’s environmental public interest litigation system and enhancing the effective governance of environmental protection.However,from the perspective of judicial practice,there are still some problems in pre-litigation procedures,such as poor alignment of various subjects,imperfect operation mechanisms for investigation and verification rights,and relatively single methods of performing duties,which affect the realization of the procedural value.Proceeding from the current situation of legislation and judicial practice,this paper puts forward countermeasures and suggestions such as clearly defining the order of the rights exercise,straightening out the work connection mechanism between various subjects,refining the rules of the operation procedure of the investigation and verification right,and exploring flexible and diverse new ways of performing duties,with a view to promoting the improvement and development of pre-litigation procedures in China and maximizing the public interests of the pre-litigation procedures to protect the environment.
