摘 要:生态环境行政公益诉讼在实现维护公益目的同时,可有效助推行政机关提升环境问题治理能力。诉讼请求作为公益代表人主张实体权利的依据,是实现相应法律效果的关键。然而,实践中生态环境行政公益诉讼请求由于受制于主观诉讼机制的干扰、“双阶段”职能定位的偏差及功能主义视角下的认识不足,呈现出内容不明确、支持率高等异向态势。应当在“目的论”作用下克服认知偏差,精准地确立行政公益诉讼请求、履职期限及履职方式,明确单一性诉讼请求及复合式诉讼请求的司法适用。The ecological environment administrative public interest litigation can effectively promote the administrative organs to improve the environmental protection governance ability when realizing the purpose of public welfare maintenance. Litigation claims, as the basis for public interest representatives to assert substantive rights, are the key to achieving corresponding legal effects. However, in practice, due to the interference of subjective litigation mechanism, the deviation of “two-level” function positioning and the lack of understanding from the perspective of functionalism, the claims of ecological environment administrative public interest litigation appear to be unclear in the content of the litigation and extremely different in the approval rate of the judgment. trend towards development. Under the influence of “skopos theory”, cognitive bias should be overcome, administrative public interest litigation claims, duty performance periods and performance methods should be accurately established, and the judicial application of single litigation claims and compound litigation claims should be reasonably determined.
