摘 要:目前,我国学界对于粮食储备的研究更多偏向于经济学方面,法学研究相对较少。随着全面依法治国战略的深化,粮食储备终将纳入法治框架。我国粮食储备法定化既是各个相关领域行政政策自我设计与完善的过程,也是代表公共意志对相关政策进行立法确认和规范的过程,更是在法治化理念下对权力与权利维度进行检视与重塑的过程。基于我国现实因素的考量,通过对国外市场主导和政府主导制度模式的比较,本文认为,应明确我国粮食储备制度的政府主导模式,以强化粮食储备制度中公权静态配置和动态干预的规范、私权主体地位和具体权利的保障。At present,the research on grain reserves in Chinese academic circles is more inclined to economics and relatively less to legal research.With the deepening of the strategy of comprehensive rule of law,grain reserves will eventually be incorporated into the framework of rule of law.The legalization of grain reserves in China is not only a process of self-design and improvement of administrative policies in various related fields,but also a process of legislative confirmation and regulation of related laws on behalf of public will,and even more a process of reviewing and reshaping the dimensions of power and rights under the concept of rule of law.Based on the consideration of realistic factors in China,this paper argues,through the comparison of foreign market-led and government-led system models,that the government-led model of China's grain reserve system should be clarified in order to strengthen the regulation of static allocation and dynamic intervention of public power,the status of private subjects and the guarantee of specific rights in the grain reserve system.
