农村宅基地“三权分置”改革进展及策略研究--基于山东省改革试点地区的田野调查

摘　　要：以山东省改革试点地区为例,依据实地调研数据分析了农村宅基地“三权分置”改革现状及问题。山东省“三权分置”改革在17个县(市、区)试点,政府相关部门和村委会通过多种方式对“三权分置”政策宣传讲解,但还不够深入;改革仍处于宅基地确权登记颁证的初级阶段,宅基地资格权的确定还存在一些障碍;宅基地相关制度及法律法规尚不完善,流转配套服务体系不健全,宅基地流转不普遍,交易仍以房屋出租为主,集约化用地效率不高,存在资源浪费现象。应深化宅基地“三权分置”改革,加强相关制度和法律法规建设,全面有效宣传宅基地“三权分置”政策,完善宅基地流转机制及配套服务体系,盘活宅基地资产,促进土地要素合理流动和有效配置,助力乡村振兴。Based on the field survey data,this paper analyzes the current situations and problems of the reform of"Separation of Three Rights"of rural residential land taking the 17 pilot areas in Shandong Province as an example.The main findings are as follows.The relevant government departments and village committees have explained and publicized the policy in various ways,but not deeply enough.The reform is still in the ini-tial stage of confirmation,registration and certification of rural residential land rights,and there are still some obstacles in the determination of qualification rights.The relevant systems and laws and regulations of rural res-idential land are not perfect and the transfer supporting service system is not well developed,which causes the problems of insufficient transfer of rural residential land,the dominated rental transactions,and the inefficiency of intensive land use and waste of resources.It is necessary to deepen the reform of"Separation of Three Rights"of rural residential land,strengthen the construction of relevant systems and laws and regula-tions,comprehensively and effectively publicize the policy,improve the transfer mechanism and supporting service system,and revitalize the assets of rural residential land,which will promote the reasonable flow and effective allocation of rural land,and contribute to the rural revitalization in the long run.
