中国特色电影分级制度的建构

摘　　要：电影分级能激发电影产业活力,转变产业增长模式,促进电影领域的善治,且更符合法治之要求,应成为电影领域深化改革的选项之一。单纯移植西方分级模式不符合我国宪法,存在法律障碍,且可能增加国家治理成本。故建构中国特色的电影分级制度,应立足于我国国情,确立国家主导、事业性与产业性相结合、法治、中立宽容、对现行秩序冲击最小的基本原则,设计符合我国国情的分级主体、标准、程序、保障、监督等环节。Film rating can stimulate the vitality of the film industry,change the industrial growth mode and promote good governance in the film field.Besides,it is more in line with the requirements of the rule of law.So it should become one of the options of deepening the reform in the film field.Simply transplanting the Western hierarchical model of film rating is not in accordance with our constitution and may increase the cost of national governance.Therefore,in order to construct the film rating system with Chinese characteristics,we should establish the basic principles of national dominance,combination of non-profit industries and profit industries,rule by law,neutrality and tolerance and minimum impact on the current order,and should design the main body of rating,standard,procedure,guarantee and supervision in line with the national conditions of China.
