摘　　要：《个人信息保护法》在立法层面明确规定了公益诉讼成为个人信息保护的救济方式,但个人信息保护公益诉讼的基础理论及实施进路仍需深入探讨。个人信息保护民事公益诉讼能够克服私益诉讼中个人与信息处理者实力不对等、维权成本高的困境,也能够弥补行政救济、刑事保护和现有其他公益诉讼的局限性。个人信息保护民事公益诉讼应当秉持个人信息保护与数据产业发展相平衡的理念,完善诉讼程序,从而推动形成公共政策乃至社会变革。基于理论、立法、实践的探索,个人信息保护民事公益诉讼在具体实施中应着重在适格当事人、诉讼请求、管辖、证明责任、行为保全、判决效力、诉讼费用等方面进行构建。Personal Information Protection Law clearly stipulates that public interest litigation becomes the relief way of personal information protection at the legislative level.But the basic theory and implementation of public interest litigation of personal information protection still need to be deeply discussed.Personal information protection civil public interest litigation can overcome the difficulties of unequal strength between individuals and information processors in private interest litigation and high cost of rights protection,and also make up for the limitations of administrative relief,criminal protection and current other public interest litigation.Personal information protection civil public interest litigation should uphold the concept of balancing personal information protection with the development of the data industry,improve the litigation procedures,so as to promote the formation of public policies and even social reform.Based on the exploration of theory,legislation and practice,the civil public interest litigation of personal information protection should be constructed in the aspects of appropriate parties,litigation claims,jurisdiction,burden of proof,act preservation,effectiveness of judgment,litigation costs and so on.
