摘　　要：《社区矫正法》的颁布标志着我国社区矫正事业进入有法可依的新发展阶段,也对社区矫正工作的规范化、专业化、法治化水平提出更高要求。简单粗疏的处遇理念与矫治需求日益多元化、差异性之间的结构性矛盾是制约新时期社区矫正工作高质量发展的瓶颈。从特殊预防的立场出发,滥觞于目的刑主义的社区矫正精准矫治理念,以处遇分流为科学方法、以复归社会为根本目标,推动社区矫正工作从大水漫灌式的粗放矫治向量体裁衣式的精准矫治转型升级。遵循《社区矫正法》吸纳精准矫治理念所确立的“分类管理与个别化矫正原则”,社区矫正精准矫治模式的构建应从风险评估动静结合、监督管理分类分级、教育帮扶因人施策三个层面具体展开,进而形塑靶向精准、科学高效、专业规范的社区矫正教育矫治运行机制,在提高教育矫正质量的同时保证刑罚执行的公正性与有效性,推动我国刑事执行体系和刑事执行能力现代化。The promulgation of the Community Corrections Law indicates that China s community correction has entered a new development stage with laws to follow,and also puts forward higher requirements for the standardization,specialization and legalization of community correction.The structural contradiction between the simple and careless treatment concept and the increasingly diversified and different correction needs is the bottleneck that hinders the high-quality development of community correction in the new era.From the standpoint of special prevention,the precise correction concept of community correction,originating from Theorie der Zweckstrafe,with the diversion of treatment as the scientific method and the return to society as the fundamental goal,promotes the transformation and upgrading of community correction from extensive correction to precise correction.In accordance with the“principles of classified management and individualized correction”established by the Community Corrections Law,the construction of the precision correction model of community correction should be carried out from three aspects:risk assessment,supervision and educational assistance,so as to shape a precise,scientific,efficient,professional and standardized operation mechanism of community correction education,which not only ensures the fairness and effectiveness of penalty execution,while improving the quality of correction education but also promotes the modernization of China s criminal execution system and execution ability.
