任意诉讼担当容许性的类型化分析

摘　　要：授权行为有效性的评价是任意诉讼担当容许性分析的核心。授权行为有效,则任意诉讼担当应被允许。被担当人的授权资格取决于被担当人的身份和关系。如果被担当人是同一法律关系的一方主体,则任意诉讼担当授权必须由全体被担当人作出决议;反之,被担当人可独立决定是否授权。授权内容不同,授权行为的性质和效力评价标准也不相同。如果被担当人授予的是实体管理权,则授权行为是私法行为,该行为的有效性可按法律行为的生效要件评价;如果授予的是诉讼实施权,则授权行为是诉讼行为,该行为以“担当人对诉讼具有法律上利益”为生效条件。在法院的裁判对担当人的法律地位有事实上的影响力时,担当人对诉讼具有法律上利益。The evaluation of the validity of the authorization act is the core of the permissibility analysis of arbitrary litigation undertaking.If the authorization act is valid,the arbitrary litigation undertaking should be allowed.The authorisation eligibility of the authorizers depends on the identity and relationship of them.If the authorizers are the subject of the same legal relationship,the authorization of arbitrary litigation undertaking must be decided by all the authorizers;otherwise,the authorizers can independently decide whether to authorize.When the content of the authorization is different,the nature of the authorization act and the criteria of validity evaluation are also different.If the authorizer grants the right to manage the entity,the authorization act is a private-law act,and the validity of the act can be evaluated according to the effective elements of the legal act.If the authorizer grants the right of litigation implementation,the authorized act is a litigation act,which is valid on the condition that the authorized person has a legal interest in the litigation.When the court s decision has a de facto influence on the principal s legal status,the principal has a legal interest in the proceedings.
