摘　　要：区块链存证作为司法领域的一次技术革新,开启了证据自证模式的先河。随着全景式侦查的思维转变,传统电子数据存证显现出易篡改等弱点,而区块链存证可实现优化侦查方法、提高侦查效率的目的,高度契合数据侦查实践。但与此同时,区块链存证与透明侦查理念也存在不可调和的矛盾,具体体现在侦查边界模糊、警情预测扩张、技术壁垒提高以及商业价值让渡4个方面。因此,有必要坚持最小干预原则、遵循无罪推定理念、充分保障辩方权利以及厘清存证平台责任,以合理规制区块链存证在数据侦查中的应用,发挥正向效能。As a technological innovation in the judicial field,blockchain deposit opens the precedent of evidence self certification mode.At present,the judicial application of blockchain deposit in China,especially in civil cases,has been gradually accepted by all sectors of society.However,in criminal cases,how to adapt blockchain deposit technology to data investigation still faces great challenges.With the change of thinking of panoramic investigation,the traditional electronic data storage shows more and more weaknesses.For example,it is easy to be tamper.The blockchain storage can achieve the purpose of optimizing investigation methods and improving investigation efficiency,which is highly consistent with the practice of data investigation.But at the same time,there are irreconcilable contradictions between blockchain deposit and the existing data investigation model,which are embodied in the fuzzy investigation boundary,the expansion of police situation prediction,the improvement of technical barriers and the transfer of commercial value.Therefore,it is necessary to adhere to the principle of minimum intervention,follow the concept of presumption of innocence,fully protect the rights of the defense and clarify the responsibilities of the deposit platform,so as to reasonably regulate the application of blockchain deposit in data investigation and give play to its positive efficiency.
