摘　　要：德沃金法哲学的特色对于现代民主通过宪法保障权利的规范性特征,特别是实质法治的理想,提供了相应的理论启示。从《认真对待权利》到《刺猬的正义》,德沃金的诠释性法理学,开启了当代法学方法论上的“诠释学转向”。诠释法理学的影响与作用在实践意义上主要是通过法律诠释与宪法的道德解读,权利与法治因此成为相互连结的两个重要概念。Dworkin’s philosophy of law can provide theoretical enlightenment to the normative character of modern democracy through the constitution,especially the ideal of substantive rule of law.Dworkin’s hermeneutic jurisprudence in Taking Rights Seriously and Hedgehog Justice,which initiates the “hermeneutic turn” in the methodology of contemporary jurisprudence.In the practical sense,the influence and function of interpretive jurisprudence are mainly done through legal interpretation and moral interpretation of the constitution.Therefore,rights and the rule of law have become two important concepts linked together.
