过度医疗侵权法律理论的修整与补充——基于111份裁判文书

摘　　要：通过案例统计,发现当前的过度医疗侵权法律理论未充分关注实践中两种重要现象:过度医疗侵害患方以外第三人权益的案件缺乏统一裁判标准,以及唯鉴定的司法认定模式阻碍了过度医疗受害人的权利救济。基于此,应对过度医疗侵权基础理论中过度医疗定义、当事人范围、损害范畴、知情同意等内容进行修整,并对过度医疗侵权法律理论加以补充:以恶意扩大损失标准确定过度医疗侵权中的患者责任,并明确医方对患方以外第三人的专家责任,规划过度医疗侵害第三人权益责任归属的判断流程。同时,由于医疗鉴定存在局限性,且非鉴定司法认定标准有一定正当性和适用范围,应构建非鉴定标准,保障受害人合法权利获得充分救济。According to the case statistics,it can be found that the current legal theory of excessive medical treatment tort has not paid enough attention to two important phenomena in practice:the cases that excessive medical treatment infringes the rights and interests of the third party other than the patient lacks uniform standards of adjudication,and the judicial identification mode of only appraisal hinders the rights relief of victims of overtreatment.Based on this,the definition of excessive medical treatment,scope of parties,scope of damage,informed consent and other contents in the basic theory of excessive medical tort should be modified,and the legal theory of excessive medical tort should be supplemented:the patient’s liability in excessive medical tort should be determined by the standard of malicious expansion of loss,and the expert liability of the doctor to the third party other than the patient should be clarified,the judging process of the division of responsibility for infringement of third party’s rights and interests by excessive medical treatment need to be planned;at the same time,due to the limitations of medical appraisal,and because the non-appraisal judicial identification standard has a certain legitimacy and some scope of application,non-appraisal standard should be established to guarantee the legal rights of victims to obtain full relief.
