摘　　要：《最高人民法院、最高人民检察院、公安部关于办理信息网络犯罪案件适用刑事诉讼程序若干问题的意见》针对当前办案实践之中反映出来的新情况新问题,依照《刑法》《刑事诉讼法》以及有关法律、司法解释的规定,结合侦查、起诉、审判实践,对信息网络犯罪案件的范围、管辖、调查核实、取证、涉案财物处理等问题作了全面系统的规定。本文对该意见的制定背景、起草中的主要考虑进行了介绍,对该意见所规定的信息网络犯罪案件管辖、调查核实、取证、账户资金推定以及涉案财物处理等重点问题作了较为深入全面的解读。The Opinions of the Supreme People’s Court,the Supreme People’s Procuratorate and the Ministry of Public Security on Several Issues Concerning the Application of Criminal Procedure in Handling Information Network Crime Cases aims at the current case dealing practice against the background of new situation and problems.In accordance with the criminal law,criminal procedure law and provisions of relevant laws and judicial interpretations,while combining with the investigation,prosecution and judicial practice,the Opinions has made comprehensive and systematic provisions to the scope,jurisdiction,investigation and verification,evidence collection and handling of property involved in the information network crime cases.This paper introduces the background,main considerations,and a relatively in-depth and comprehensive interpretation is made on key issues such as jurisdiction,investigation and verification,evidence collection,presumption of account funds,and disposal of assets.
