总体国家安全观视域下安全刑法理念的现实化路径

摘　　要：总体国家安全观根据社会需求应时而出并不断发展完善,能够科学有效地指导国家安全实践。以总体国家安全观为精神内核的安全刑法理念具有鲜明的时代性、辩证性与现实性。安全刑法理念的实现是时代课题,域内外的刑法立法都已表现出安全刑法理念的立法具象,这不仅具有合宪性依据,而且有利于实现刑罚的综合预防目的和贯彻宽严相济的刑事政策。事实上,安全刑法与自由刑法并非根本对立,二者具有统一性。为平衡刑法的安全与自由价值,应以总体国家安全观为指导,从安全刑法的三重面向和安全刑法的扩张与收缩两方面实现安全刑法的科学架构,进而为当前安全刑法领域的热点问题提供解决思路,实现自由理想与现实安全的平衡。The overall national security concept according to the social needs and constantly develop and improve, can scientifically and effectively guide the practice of national security.The concept of security criminal law with the overall national security concept as the spiritual core has distinct times, dialectic and reality.The realization of the concept of safe criminal law is the subject of the times. The criminal law legislation inside and outside the region has shown the legislative embodiment of the concept of safe criminal law, which not only has the constitutional basis, but also is conducive to the realization of the comprehensive prevention purpose of punishment and the implementation of the criminal policy of combining mercy with severity.In fact, the security criminal law and the freedom criminal law are not fundamentally opposite, the two have the unity.To balance the security and freedom value of criminal law, should be guided by the overall national security concept, from the triple orientation of security criminal law and the expansion of security criminal law and shrink the scientific architecture of security criminal law, and then provide solutions for the current hot issues in the field of security criminal law, realize the balance of freedom ideal and realistic security.
