摘　　要：The construction of the public nature of the business membership organization is of great significance for the building of social governance with the nature of co-building,co-governing and co-sharing,but the public nature of current business membership organizations is showing the dependence of state public nature.The public nature of business membership organizations has vital rule of law value for the state,market,social public activities and the industry itself.The process of re-construction for the public nature of the business membership organization is also the process of rule of law,which shall begin from the market-oriented reform,establishing the negative list system,using the rule of law way to guarantee the role of public nature,expanding and regularizing the consultancy channel,establishing and improving the multi-party supervision mechanism.The discussion of the public nature of business membership organizations shall focus on how the state,public organizations and society form an interactive relationship in a dynamic way,then exploring the possibility of interdependence and mutual cooperation.商会公共性构建对于打造共建共治共享的社会治理格局有重要意义,但现今商会的公共性表现出对国家公共性的依附。商会的公共性对国家、市场、社会公共生活和行业本身都具有重要的法治价值。重构商会的公共性是法治化的过程,应该从市场化入手,建立负面清单制度,用法治思维保障公共性的发挥,拓宽建言渠道,建立健全的多方监督机制。对商会公共性的讨论应该着眼于“国家”“公共组织”“社会”之间如何在动态中形成互动关系,继而探寻相互借助相互合作的可能。
