未成年人社区矫正调查评估程序正当化建构

摘　　要：社区矫正调查评估是决定对未成年人进行社区矫正的重要参考依据。我国《社区矫正法》中规定对未成年人是“可以”而非“应当”进行调查评估。该种规定不利于保障未成年人在社区矫正中的合法权益。在推动未成年人“个别化”矫正过程中,基于宽严相济刑事政策的内涵,为确保对未成年人依法量刑,同时保障社区矫正的效果,“应当”对未成年人社区矫正判前进行调查评估。实现未成年人社区矫正调查评估程序正当化的建构,需要在立法上规定未成年人社区矫正之前“应当”进行调查评估、明确调查评估报告的法律属性以及提前启动调查评估等措施,司法上设立调查评估庭前审查、庭中控辩和庭后公示等程序。在提升未成年人社区矫正质量和效果的同时,应加强未成年人在社区矫正过程中合法权益的保护。Community correction investigation and evaluation is an important reference basis for determining community correction for minors.China’s Community Correction Law stipulates that minors can be investigated and evaluated instead of“should”,which is not conducive to protecting the legitimate rights and interests of minors in community correction.In the process of promoting the“individualization”correction of minors,based on the connotation of the criminal policy of combining leniency and severity,in order to ensure that minors are sentenced in accordance with the law and at the same time ensure the effect of community correction,the pre-judgement of community correction of minors should be investigated and evaluated.To realize the legitimate construction of the investigation and evaluation process for the community correction of minors,it is necessary to stipulate that the legislation stipulates that the investigation and evaluation of the community correction of minors shall be carried out,the legal attributes of the investigation and evaluation report shall be clarified,and the investigation and evaluation shall be initiated in advance.Judicial procedures such as investigation and evaluation pre-trial review,in-court prosecution and defense and after-court publicity are established.While improving the quality and effect of community correction of minors,we will strengthen the protection of the legitimate rights and interests of minors in the process of community correction.
